Why Shred?
Identity Theft
In today's business environment, it is of the utmost importance that companies take every precaution to protect individual's personal and/or company trade information. Businesses have an "implied contract" to protect the sensitive information that they routinely gather in order to conduct business. The casual discarding of information exposes customers to the threat of "Identity Theft" and other fraud. Consumers have the legal right to expect you to take every precaution to protect their sensitive data, including shredding it before it is discarded.
The Law
There are laws and regulations in existence that mandate the destruction of discarded information. Some of these applicable laws are:
- The Privacy Act of 1974
- California vs Greenwood, May 1988 (Dumpster Diving Law)
- Health Insurance Portability and Accountability Act of 1996 (HIPPA)
- The Gramm-Leach-Bliley Act of 1999
- California Assembly Bill 2246, October 2001 (California Shredding Law)
- Sarbanes-Oxley Act of 2002
- Fair and Accurate Credit Transactions Act (FACTA) of 2005
Corporate Ethics
In order for businesses to minimize the appearance of impropriety when disposing of documents, the National Association of Information Destruction (NAID) suggests adherence to the following guidelines:
- SHRED on a regular schedule
- Use a shredding contractor for ALL of your shredding needs
- Treat all documents equally…SHRED everything
- Have a destruction policy
